Article352(2)oftheCRRprovidesthat: AnypositionswhichaninstitutionhasdeliberatelytakeninordertohedgeagainsttheadverseeffectoftheexchangerateonitsratiosinaccordancewithArticle92(1)may,subjecttopermissionbythecompetentauthorities,beexcludedfromthecalculationofnetopencurrencypositions.Suchpositionsshallbeofanon-tradingorstructuralnatureandanyvariationofthetermsoftheirexclusion,subjecttoseparatepermissionbythecompetentauthorities.Thesametreatmentsubjecttothesameconditionsmaybeappliedtopositionswhichaninstitutionhaswhichrelatetoitemsthatarealreadydeductedinthecalculationofownfunds. TheguidelinessetobjectivecriteriathatMemberStatecompetentauthoritiesshouldconsiderforthepurposeofassessingwhethertheconditionssetoutinArticle352(2)forreceivingthepermissionaremet,whilegrantingabalanceofflexibility. TheguidelinesrelatetothecurrentmarketriskframeworkbuttheEBAhasalsoconsideredthechangesintroducedbytheCCR2whichbuildsonthenewFundamentalReviewoftheTradingBook(FRTB)standardspublishedbytheBaselCommitteeonBankingSupervisioninJanuary2019,andtakingintoaccountthestructuralFXtreatmentenvisagedinthosestandards. TheguidelinesalsohavebeendesignedsothatinstitutionsorMemberStatecompetentauthoritieswillnotberequiredtorequestorgrantanewpermissiononceinstitutionsswitchfromthecurrentframeworktotheFRTBframeworkforcomputingtheownfundsrequirementsformarketrisk.
