IntelSoftwareLicenseAgreementWithOSSExclusionThetermsofthesoftwarelicenseagreementincludedwithanysoftwareyoudownloadwillcontrolyouruseofthesoftware.INTELSOFTWARELICENSEAGREEMENTIMPORTANT-READBEFORECOPYING,INSTALLINGORUSING.Donotuseorloadthissoftwareandanyassociatedmaterials(collectively,the"Software")untilyouhavecarefullyreadthefollowingtermsandconditions.ByloadingorusingtheSoftware,youagreetothetermsofthisAgreement.Ifyoudonotwishtosoagree,donotinstallorusetheSoftware.LICENSES:PleaseNote:-Ifyouareanetworkadministrator,the"SiteLicense"belowshallapplytoyou.-Ifyouareanenduser,the"SingleUserLicense"shallapplytoyou.-Ifyouareanoriginalequipmentmanufacturer(OEM),the"OEMLicense"shallapplytoyou.-TheSoftwaremaycontainthesoftwareandotherpropertyofthirdpartysuppliers,someofwhichmaybeidentifiedin,andlicensedinaccordancewith,anattached“thirdpartylicensedirectory”orothersimilarlynamedtextorfile.Inparticular,withoutlimitation,thislicensedoesnotapplytotheopensourcecomponentsdistributedwiththeSoftware.Thecorrespondingopensourcelicensesareattachedtotheopensourcecomponentsandaretheonlylicensesthatapplytotheopensourcecomponents.SITELICENSE.YoumaycopytheSoftwareontoyourorganization'scomputersforyourorganization'suse,andyoumaymakeareasonablenumberofback-upcopiesoftheSoftware,subjecttotheseconditions:1.ThisSoftwareislicensedforuseonlyinconjunctionwithIntelcomponentproducts.UseoftheSoftwareinconjunctionwithnon-Intelcomponentproductsisnotlicensedhereunder.2.Youmaynotcopy,modify,rent,sell,distributeortransferanypartoftheSoftwareexceptasprovidedinthisAgreement,andyouagreetopreventunauthorizedcopyingoftheSoftware.3.Youmaynotreverseengineer,decompile,ordisassembletheSoftware.4.YoumaynotsublicenseorpermitsimultaneoususeoftheSoftwarebymorethanoneuser.5.TheSoftwaremayincludeportionsofferedontermsinadditiontothosesetouthere,assetoutinalicenseaccompanyingthoseportions.SINGLEUSERLICENSE.YoumaycopytheSoftwareontoasinglecomputerforyourpersonal,noncommercialuse,andyoumaymakeoneback-upcopyoftheSoftware,subjecttotheseconditions:1.ThisSoftwareislicensedforuseonlyinconjunctionwithIntelcomponentproducts.UseoftheSoftwareinconjunctionwithnon-Intelcomponentproductsisnotlicensedhereunder.2.Youmaynotcopy,modify,rent,sell,distributeortransferanypartoftheSoftwareexceptasprovidedinthisAgreement,andyouagreetopreventunauthorizedcopyingoftheSoftware.3.Youmaynotreverseengineer,decompile,ordisassembletheSoftware.4.YoumaynotsublicenseorpermitsimultaneoususeoftheSoftwarebymorethanoneuser.5.TheSoftwaremayincludeportionsofferedontermsinadditiontothosesetouthere,assetoutinalicenseaccompanyingthoseportions.OEMLICENSE:YoumayreproduceanddistributetheSoftwareonlyasanintegralpartoforincorporatedinYourproductorasastandaloneSoftwaremaintenanceupdateforexistingendusersofYourproducts,excludinganyotherstandaloneproducts,subjecttotheseconditions:1.ThisSoftwareislicensedforuseonlyinconjunctionwithIntelcomponentproducts.UseoftheSoftwareinconjunctionwithnon-Intelcomponentproductsisnotlicensedhereunder.2.Youmaynotcopy,modify,rent,sell,distributeortransferanypartoftheSoftwareexceptasprovidedinthisAgreement,andyouagreetopreventunauthorizedcopyingoftheSoftware.3.Youmaynotreverseengineer,decompile,ordisassembletheSoftware.4.YoumayonlydistributetheSoftwaretoyourcustomerspursuanttoawrittenlicenseagreement.Suchlicenseagreementmaybea"break-the-seal"licenseagreement.AtaminimumsuchlicenseshallsafeguardIntel'sownershiprightstotheSoftware.5.TheSoftwaremayincludeportionsofferedontermsinadditiontothosesetouthere,assetoutinalicenseaccompanyingthoseportions.NOOTHERRIGHTS.NorightsorlicensesaregrantedbyInteltoYou,expresslyorbyimplication,withrespecttoanyproprietaryinformationorpatent,copyright,maskwork,trademark,tradesecret,orotherintellectualpropertyrightownedorcontrolledbyIntel,exceptasexpresslyprovidedinthisAgreement.OWNERSHIPOFSOFTWAREANDCOPYRIGHTS.TitletoallcopiesoftheSoftwareremainswithInteloritssuppliers.TheSoftwareiscopyrightedandprotectedbythelawsoftheUnitedStatesandothercountries,andinternationaltreatyprovisions.YoumaynotremoveanycopyrightnoticesfromtheSoftware.IntelmaymakechangestotheSoftware,ortoitemsreferencedtherein,atanytimewithoutnotice,butisnotobligatedtosupportorupdatetheSoftware.Exceptasotherwiseexpresslyprovided,IntelgrantsnoexpressorimpliedrightunderIntelpatents,copyrights,trademarks,orotherintellectualpropertyrights.YoumaytransfertheSoftwareonlyiftherecipientagreestobefullyboundbythesetermsandifyouretainnocopiesoftheSoftware.LIMITEDMEDIAWARRANTY.IftheSoftwarehasbeendeliveredbyIntelonphysicalmedia,IntelwarrantsthemediatobefreefrommaterialphysicaldefectsforaperiodofninetydaysafterdeliverybyIntel.Ifsuchadefectisfound,returnthemediatoIntelforreplacementoralternatedeliveryoftheSoftwareasIntelmayselect.EXCLUSIONOFOTHERWARRANTIES.EXCEPTASPROVIDEDABOVE,THESOFTWAREISPROVIDED"ASIS"WITHOUTANYEXPRESSORIMPLIEDWARRANTYOFANYKINDINCLUDINGWARRANTIESOFMERCHANTABILITY,NONINFRINGEMENT,ORFITNESSFORAPARTICULARPURPOSE.Inteldoesnotwarrantorassumeresponsibilityfortheaccuracyorcompletenessofanyinformation,text,graphics,linksorotheritemscontainedwithintheSoftware.LIMITATIONOFLIABILITY.INNOEVENTSHALLINTELORITSSUPPLIERSBELIABLEFORANYDAMAGESWHATSOEVER(INCLUDING,WITHOUTLIMITATION,LOSTPROFITS,BUSINESSINTERRUPTION,ORLOSTINFORMATION)ARISINGOUTOFTHEUSEOFORINABILITYTOUSETHESOFTWARE,EVENIFINTELHASBEENADVISEDOFTHEPOSSIBILITYOFSUCHDAMAGES.SOMEJURISDICTIONSPROHIBITEXCLUSIONORLIMITATIONOFLIABILITYFORIMPLIEDWARRANTIESORCONSEQUENTIALORINCIDENTALDAMAGES,SOTHEABOVELIMITATIONMAYNOTAPPLYTOYOU.YOUMAYALSOHAVEOTHERLEGALRIGHTSTHATVARYFROMJURISDICTIONTOJURISDICTION.TERMINATIONOFTHISAGREEMENT.IntelmayterminatethisAgreementatanytimeifyouviolateitsterms.Upontermination,youwillimmediatelydestroytheSoftwareorreturnallcopiesoftheSoftwaretoIntel.APPLICABLELAWS.ClaimsarisingunderthisAgreementshallbegovernedbythelawsofCalifornia,excludingitsprinciplesofconflictoflawsandtheUnitedNationsConventiononContractsfortheSaleofGoods.YoumaynotexporttheSoftwareinviolationofapplicableexportlawsandregulations.IntelisnotobligatedunderanyotheragreementsunlesstheyareinwritingandsignedbyanauthorizedrepresentativeofIntel.GOVERNMENTRESTRICTEDRIGHTS.TheSoftwareisprovidedwith"RESTRICTEDRIGHTS."Use,duplication,ordisclosurebytheGovernmentissubjecttorestrictionsassetforthinFAR52.227-14andDFAR252.227-7013etseq.oritssuccessor.UseoftheSoftwarebytheGovernmentconstitutesacknowledgmentofIntel'sproprietaryrightstherein.ContractororManufacturerisIntel2200MissionCollegeBlvd.,SantaClara,CA95052.
