Forexistingships,theBWMConventionrequiresthateithertheD1(exchange)orD2(treatment)standardismetafterentryintoforce(8September2017).However,asballastwaterexchange(D1)isnotconsideredanidealmethodofballastwatermanagement,theBWMConventionrequirescompliancewithD2(treatment)uponaship’sfirstInternationalOilPollutionPrevention(IOPP)Certificaterenewalsurveyafter8September,2017. TheConventionallowsforcertainvesselsmeetingspecificconditionstobeexemptfromtheBWMstandards.However,gainingsuchanexemptionisexpectedtobeahighriskprocess. RoleswithintheBWMConvention Administrator TheMaritimeandCoastguardAgency(MCA)isresponsibleforimplementingtheBWMConventionwithintheUK,throughanationalBallastWaterManagementStrategy. ShipOperators/Owners Shipoperators/ownersareresponsibleforensuringvesselsarecompliantwiththeBWMConvention.Predominantly,thiswillinvolvetheinstallationofanapprovedballastwatertreatmentsystemon-boardvessels. PortandHarbourAuthorities TheBWMConventiondoesnotplaceanyspecificlegalobligationsonportandharbourauthoritiesinrelationtoballastwatertreatment.However,therearecertainmeasuresportscouldchoosetoputinplaceinorderinsupporttotheimplementationoftheBWMConventionandtoensuretheprotectionofthelocalenvironment.Theseinclude: Providingonshoreorbargebasedreceptionfacilitiesforcleaningorstoringballastwater-theConventionallowsfortheuseof‘OtherMethods’ofballastwatermanagementprovidedtheyensurethesamelevelofprotectionasdetailedinRegulationsD1(exchange)andD2(treatment).Any‘OtherMethod’proposedmustbeapprovedbytheMEPCCommitteeoftheIMO; ImplementingBallastWaterManagementPlans-BWMPlanscanbeusedbyportsorharbourauthoritiesto: Informlocalagentsand/orshipsofareasandsituationswhereuptakeofballastwatershouldbeencouragedoravoided; Encouragetheexchangeofballastwateratsea(whereitissafetodoso);and Discourageunnecessarydischargeofballastwater. Assistingintheexemptionsapplicationprocess-theConventiondoesallowforexemptionstobeissued.However,eventhoughtheUKGovernmenthavestatedtheirintentiontohaveanexemptionsystem,theUKcannotguaranteethatthefinalnationallegislationwillincludetheabilitytoissueexemptionsasthewiderissuesoftheenvironmentandbiodiversityarelikelytohavetobetakenintoconsideration. Inaddition,sedimentreceptionfacilitiesmayneedtobeprovidedformaterialsfilteredoutofballastwaters.Thesearemostlikelytoberequiredinthevicinityofshipyardsanddrydocks. Nextsteps TheratificationoftheBWMConventionallowsindustryandgovernmentstostartplanningactionsneededtocomplywiththeConvention. Inparticular,theUKGovernmentislikelytosetouttheirpositioninrelationtotheBWMConventionandwillthusprovidefurtherclarityontheroleofportandharbourauthorities.
